Terms of Service

Overview
These Terms of Service ("Terms") govern your access to and use of takemyboattest.comand any related sites, services, and products (collectively, the "Site"), owned and operated by Take My Boat Test LLC ("TMBT," "we," "us," or "our"). By using the Site, you agree to abide by all Terms presented here.
IMPORTANT: THESE TERMS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.
Intellectual property
All content on the Site — including images, text, logos, course curriculum, documents, and downloadable files — is the property of Take My Boat Test LLC and its content creators. You may not reproduce, distribute, or create derivative works without express written permission.
Accounts
When creating an account, you agree to:
- Be solely responsible for account security, passwords, and sensitive information.
- Ensure all personal information you provide is current, accurate, and truthful.
- Update your information whenever changes occur (especially mailing address for certificate fulfillment).
We reserve the right to suspend or terminate accounts used illegally or in violation of these Terms.
Sale of goods
These Terms govern all goods available on the Site, specifically our Boater Safety Education Certification courses. All product descriptions and images are provided as accurately as possible, though we are not legally bound by such descriptions, images, or third-party reviews. You purchase at your own discretion.
We reserve the right to modify, reject, or cancel orders when necessary (for example, in the case of suspected fraud or duplicate enrollment). If payment has been processed before cancellation, a refund will be issued in accordance with our Refund Policy.
Course access & expiration
Standard courses include 90 days of access from the date of purchase. Once you have passed your final exam and we have issued your certificate, your account access remains active so you can print or retrieve your certificate at any time. Some state-specific products (e.g. Florida Temporary) follow different rules, which are disclosed on each product page at the time of purchase.
Payments
We currently accept the following payment methods:
- Credit card (Visa, Mastercard, American Express, Discover)
- Debit card
- Apple Pay, Google Pay, and Link (where available)
By providing payment information, you authorize TMBT (via our payment processor Stripe) to charge the payment instrument for amounts due. Stripe stores your card number and handles authorization; we do not see or store your full card details.
Consumer protection law
These Terms do not limit your legal rights under applicable consumer protection legislation. If a conflict exists between these Terms and any mandatory legislative provision, the legislation takes precedence.
Limitation of liability
Take My Boat Test LLC and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, or expenses (including legal fees) arising from your use of the Site, except where such limitation is prohibited by law.
Indemnity
By using the Site, you agree to indemnify and hold harmless TMBT and its representatives from actions, claims, losses, damages, liabilities, and expenses arising from your use of the Site or your violation of these Terms.
Applicable law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles.
Dispute resolution
Disputes must first be addressed through informal discussion. If unresolved, the parties agree to submit to non-binding mediation, and then to binding arbitration if mediation fails.
Exception: both parties retain the right to pursue small claims court, injunctive relief, or intellectual property infringement actions in court.
Severability
If any provision of these Terms is found invalid under applicable law, that provision will be removed while all other provisions remain valid and in force.
Changes to these Terms
These Terms may be amended to maintain legal compliance and reflect operational changes. We will notify users of material changes via email or Site notice prior to the changes taking effect.
Contact & communications
By signing up, you agree that we may contact you by email regarding your course purchase, progress, and completion, and about related offers such as upgrading a temporary certificate to a lifetime one. You may unsubscribe from marketing email at any time using the link at the bottom of any marketing message, or the unsubscribe page.
Transactional emails (receipts, course progress, certificate delivery) are part of the service and cannot be opted out of while you have an active enrollment.
We do not currently send text messages. If we introduce SMS, we will ask for your consent to it separately and specifically at that time — agreeing to these Terms is not consent to receive text messages.
